Terms and Conditions

This Agreement sets forth the terms governing your use of the “2 Truths and a Lie” services (“the Services”). which are accessible through your use of the 'Two Truths and a Lie' application. By using the Services, you agree to these Terms of Use; if you do not agree to all of these Terms of Use, do not use these Services.

The Services are made available to you, as an individual person, non-exclusively by International Business Machines Corporation (“IBM”) at no charge via an Internet connection provided by you.

The Services and any related software, documentation, content or other materials provided by IBM in connection with the Services are owned by IBM, and are copyrighted and licensed, not sold. All results generated by the Services are owned by IBM or its suppliers. Transfer of your rights under this Agreement is not permitted.

You are authorized to use the Services and associated content for your own personal use for informational purposes only. The Services are not intended to be used for productive or commercial purposes, and such use is not permitted.

Your use of the Services is also subject to IBM's Online Application Privacy Statement http://www.ibm.com/privacy/details/us/en/.

The Services may be unavailable during scheduled maintenance determined by IBM, and other scheduled or non-scheduled downtimes may occur. Either party may terminate use or access to the Services at any time.

IBM will collect facial images and videos and use them for purposes of providing the Services.

Video clips will be stored for a period of time up to 6 months. You are solely responsible for your use of the Services and associated content and the results obtained from their use. Your use of the results of the Services, including use of generated video, is solely at your own risk and IBM and its suppliers, disclaim all liability and responsibility for those results or any use of them by you or any other party. You are also responsible for any information, data or other materials (“User Materials”) that you submit or provide in connection with the Services, including ensuring that you have all necessary authorizations to permit IBM and its subcontractors to use, host, cache, record, copy and display such User Materials without charge. IBM has no responsibility for the User Materials that you submit or provide in connection with the Services. All User Materials which you submit or provide to the Services or to IBM are non-confidential.

You are prohibited from doing any of the following with respect to the Services:

Using, copying, modifying, transferring or making the Services available, in whole or in part, to any third parties, or otherwise disclosing the Services and any information IBM provides or makes available to you in connection with the Services to any other party except as expressly authorized by this Agreement or otherwise permitted by IBM in writing;

Reverse assembling, reverse compiling or otherwise translating, or reverse engineering the Services (except as expressly permitted by law without possibility of contractual waiver);

Creating any Internet links to or from the Services, unless separately authorized by IBM in writing; and

Framing or mirroring any content included with the Services (other than in connection with the authorized use of the Services).

THE SERVICES AND ASSOCIATED CONTENT AND THE RESULTS GENERATED BY THE SERVICES ARE PROVIDED “AS IS”, WITH NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IBM AND ITS AFFILIATES AND SUPPLIERS, WILL NOT BE LIABLE, UNDER ANY CONTRACT, TORT, STRICT LIABILITY, OR OTHER THEORY, FOR ANY DIRECT, SPECIAL, PUNITIVE, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF OR DAMAGE TO DATA, LOSS OF ANTICIPATED REVENUE, PROFITS, SAVINGS, OR GOODWILL, WORK STOPPAGE OR IMPAIRMENT OF OTHER ASSETS, WHETHER OR NOT FORESEEABLE AND WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ARE RESPONSIBLE FOR COMPLIANCE WITH ANY APPLICABLE LAWS AND REGULATIONS WHICH MAY GOVERN YOUR ACCESSING AND USE OF THE SERVICES.

IBM is not responsible for the content or privacy practices of any third party applications or website.

The laws of the State of New York, excluding its conflicts of laws rules, govern this Agreement and your use of the Services.

IBM wants to know what you think about the Services and how IBM can make them better. You can do this by providing your comments and feedback via online forums or other submission vehicles which IBM makes available to you. By providing your comments and feedback to IBM, you authorize IBM and its solution partners to publish and display them and to use them in the development and enhancement of their products and services.

The foregoing is the complete agreement between you and IBM regarding your use of the Services and replaces any prior communications related to such use. By accessing and using the Services you are confirming that you have read and agreed to these Terms of Use. IBM may changes these Terms of Use at any time. Your continued use of the Services after any such changes are made will constitute your acceptance and agreement to any changed or new terms.

The Application Privacy Statement (“Statement”) sets forth the privacy practices of IBM relating to information it collects through this “2 Truths and a Lie with Watson” application (the "App").

This Statement identifies the data elements collected by the App and the practices regarding IBM's use and protection of such data. If this Statement is silent as to a particular data element (such as, for example, geo location data), then the App does not collect that data element. You should read this Statement before downloading, accessing, or otherwise using the App. Downloading, accessing, or otherwise using the App indicates that you have read this Statement and consent to its terms. If you do not consent to the terms of this Statement, do not proceed to download, access, or otherwise use the App.

Information Collection and Use

To use some features of the App, you may be required to register and provide personal information, including your name, email address, Facebook ID and/or IBM ID, password, security question and answer. If you choose to log-in with Facebook we will use only your basic public profile information to identify you. By logging in with Facebook you are not giving IBM permission to post on your wall.

Please keep in mind that you may not be able to use some or all of the features offered by the App unless you provide such information. Each time you log-in to the App, your IBM or Facebook profile information may be used to verify you as a registered user. If you provide personal information in registering for the App, such information will be handled, used, shared and retained by IBM as provided in the ibm.com privacy policy at http://www.ibm.com/privacy/details/us/en/

In addition, the App collects usage information automatically, including: your access of the App, features you use, ingredients you use, dishes you create or share, your frequency of use, the number and type of feedback questions, and your device type, OS type, browser, and location. IBM may combine this information with information gathered from other IBM applications or services. IBM may use the information we collect, both individually and in aggregate, to provide and maintain the App and other IBM services, for diagnostic, usage, and performance analytics, to improve your experience with the App and other IBM services, or to create new applications or services.

Cookies

IBM uses cookies and/or other web tracking technology through the App. The information we collect may be combined to help us improve the App or to help us better tailor our interactions with you. Children's Privacy

IBM does not use the App to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at http://www.ibm.com/scripts/contact/contact/us/en/privacy/ We will delete such information from our files within a reasonable time.

Privacy Policy Updates

This Statement may be updated from time to time for any reason. We will notify you of any changes to this Statement by posting a new version at http://www.ibm.com/privacy/details/us/en/.

By using the App, you consent to the processing of the information collected by the App as set forth in this Statement now or as amended.
